La Città metropolitana è uno degli enti locali territoriali previsti nella Costituzione, all'articolo 114.[1] L'articolo 23 del Testo unico degli enti locali (decreto legislativo 18/08/2000 n. 267) ne disciplinava l'istituzione ma è stato successivamente abrogato dal decreto legislativo di revisione della spesa n. 95/2012, convertito in legge n. 135/2012.
Il decreto legge sulla cosiddetta spending review stabilisce che le città metropolitane debbano essere istituite tassativamente[2] a partire dal 1º gennaio 2014, e non più, quindi, in maniera facoltativa come prevedeva il D.Lgs. 267/2000 all'articolo 23.
Il 3 luglio 2013, la Corte Costituzionale ha però dichiarato l'illegittimità costituzionale degli articoli 17 e 18 del decreto legge sulla spending review.[3].
Il decreto legge sulla cosiddetta spending review stabilisce che le città metropolitane debbano essere istituite tassativamente[2] a partire dal 1º gennaio 2014, e non più, quindi, in maniera facoltativa come prevedeva il D.Lgs. 267/2000 all'articolo 23.
